We issue a warranty on the delivered products under the following conditions.

MPoolCover issues a warranty in respect of the delivered products under the following conditions.

MPoolCover guarantees that the product is free of material defects and construction defects. In the event
of any damage to the product which, at the discretion of MPoolCover, finds its origin in material and/or structural defects, this damage will be remedied. If a repair on location appears not to be possible, this being at the discretion of MPoolCover, a replacement product will be delivered.

Warranty period

All warranty periods start on the date of purchase of the products. MPoolCover delivery note is decisive in the determination of this date. In the event of the delivery of a replacement product, any consequential loss, such as costs of disassembly, instalment of the new product with accessories, travel and accommodation costs, does not fall under the warranty.

Exclusions

The damage to the product which has a different cause than material or construction defects is not covered by the warranty. Excluded in any event are, for instance, damage to the product caused by:

  • Incompetent assembly, which includes in any event assembly which has not been carried out in accordance with Mpoolcover’s instructions
  • Incompetent or overdue maintenance
  • External chemical or mechanical causes
  • Incorrect use, corrosion, incorrect water treatment
  • Rust formation on stainless steel components in pools treated with salt electrolysis
  • Influences of ground and/or surface water
  • Repairs carried out or changes made by a third party
  • Effects of aggressive liquids, fumes and gasses
  • Overheating of the slats by direct sunlight due to the slats not being in contact with the pool water
  • The filtration system being turned off
  • The direct contact of the motor (apart from immerged motors) and/or control panel with water
  • Lightning strike, fire or natural disasters
  • Hail

Are also excluded from the warranty any of the following:

  • Discolouring of surfaces or material, whether or not caused by the water treatment
  • Damage, scratches and wear as a result of the use of the product
  • The occurrence of condensation in solar and/or transparent slats

Claims

If the buyer detects damage to the product, irrespective of whether or not this damage falls under this guarantee, MPoolCover must be immediately contacted at all times. MPoolCover will investigate the complaint of the buyer. If MPoolCover finds or suspects that there is a material and/or construction defect which falls under thi warranty, this warranty condition can be invoked. This waranty is issued to the buyer under the following conditions: the complaint or damage must first be investigated by MPoolCover; the buyer has satisfied all his obligations towards MPoolCover, including the full payment of the price due.

Procedure

For small parts or removable components, MPoolCover requests that the allegedly defective item is sent back for analysis. All parts must be labelled with the buyer’s name, customer reference, order or invoice number and description of the alleged defect, and forwarded to the following address:

In order to avoid long processes, MPoolCover can, at the buyer’s request, supply a replacement item payable 30 days after its issue date. If the warranty is confirmed after analysis, the invoice will be cancelled by a credit note. If, after analysis, MPoolCover confirms that the warranty is not admissible, she has the right to request the payment of the replacement item sent. If, within 30 days, MPoolCover has not received the allegedly defective item, it will also have the right to request the payment of the replacement item sent. For bigger items, the buyer agrees to supply pictures showing the alleged defect of the item or the problem encountered with the item. For slat related issues, the buyer agrees to supply pictures and send a sample back for analysis.

Return charges are under the buyer’s responsibility.
